User Agreement / Terms of Use
Purpose of the Agreement
This User Agreement ("Agreement," "Terms of Use," or "Terms") establishes the legal framework between
you ("User," "Visitor," "Member," or "you") and Llalama ("we," "our," or "Llalama"). This Agreement governs your access to and use of the Llalama platform, including our website and any associated mobile applications (collectively referred to as the "Platform"). By using this Platform, you acknowledge that you have read, understood, and agreed to these Terms.
If you do not agree, you must cease all usage of the Platform immediately.
Scope of the Agreement
Llalama operates as a complaint resolution platform that connects consumers with businesses
for the purpose of expressing dissatisfaction and seeking resolution. By utilizing our services,
you agree to share information and content as deemed appropriate.
The use of the Platform is at your sole risk, and you agree that Llalama cannot be held responsible
for any consequences arising from
your engagement with the Platform
Age Requirement and Eligibility
To use Llalama, you must be at least 13 years old. If creating an account,
you must be 18 years or older. By using our platform, you affirm that you meet these age
requirements and have the
legal capacity to enter into this Agreement.
Account Creation and Security
To access certain features of the Platform, you will need to create an account ("Membership").
You agree to provide accurate, up-to-date, and complete information during the registration process.
You are responsible for maintaining the confidentiality of your account credentials
and for all activities conducted through your account.
If you suspect unauthorized access to your account, you must notify us immediately.
User Conduct and Responsibilities
Users must adhere to all applicable laws and not engage in any behavior that is harassing, abusive,
defamatory, or otherwise harmful to others. You agree not to submit false information or complaints,
misrepresent your identity or affiliation, or engage in activities
that may disrupt the Platform's operation.
Content Submission and Ownership
By submitting complaints, reviews, or any other content on the Llalama platform, you retain
ownership of that content. However, you grant Llalama a non-exclusive, worldwide, perpetual,
royalty-free license to use, reproduce, modify, and distribute your content as needed to operate the Platform.
You represent and warrant that you have the rights to any content you submit.
Monitoring and Moderation
While Llalama strives to maintain a respectful and constructive environment,
we do not review every piece of content submitted. We reserve the right to remove any content at our
discretion that violates these Terms or is deemed inappropriate, without prior notice to the user.
Users retain the responsibility for their submissions.
Limitation of Liability
To the maximum extent permitted by law, Llalama will not be liable for any indirect, incidental,
or consequential damages arising from your use of the Platform or any content provided therein.
The sole remedy for dissatisfaction with Llalama is to stop using our services.
This limitation applies regardless of whether the liability arises from a breach of contract, tort,
negligence, or any other legal theory.
Dispute Resolution and Governing Law
Any disputes arising from this Agreement or your use of the Platform shall be resolved amicably
through dialogue. If unresolved, such disputes shall be governed by the laws of
Kenya and resolved in the competent courts thereof.
You agree to the personal jurisdiction of these courts.
Changes to This Agreement
Llalama reserves the right to modify these Terms at any time. Changes will take effect immediately
upon posting on the Platform. Users are encouraged to review these Terms periodically for updates.
Your continued use of the Platform after changes signifies your acceptance of the new Terms.
Third-Party Links
The Platform may contain links to third-party websites or services. Llalama does not endorse or
assume any responsibility for the content or practices of these third-party sites. Your interactions
with such sites are solely between you and the third party, and Llalama shall not be held liable for
any damages arising
from those interactions.
Termination
Llalama reserves the right to suspend or terminate your account at any time without prior notice if
you violate these Terms or engage in conduct that we deem inappropriate. Upon termination, all
provisions of this Agreement that, by their nature, should survive
termination will remain in effect.
